Colorado Month-to-Month Lease Agreement

A Colorado month-to-month lease agreement is a document used to create a tenancy at will that can be canceled at any time within the statutory notice period. The landlord grants preference to the tenant if they stay on the property for extended periods with a maximum of three (3) months’ notice if the tenancy lasts one (1) year or longer.

Required Minimum Notice

  • A tenancy for one (1) year or longer, three (3) months;
  • A tenancy of six (6) months or longer but less than a year, one (1) month;
  • A tenancy of one (1) month or longer but less than six (6) months, ten (10) days;
  • A tenancy of one (1) week or longer but less than one (1) month, or a tenancy at will, three (3) days;
  • A tenancy for less than one (1) week, one (1) day.
