New York Month-to-Month Rental Agreement

A New York month-to-month rental agreement is a rental contract with no end date and can be terminated by either the landlord or tenant within one (1) month’s notice. The lease will renew automatically with each month and the tenant’s rent payment. During a month-to-month lease, the landlord can increase the rent in accordance with the Rent Protection Guidelines. It is recommended that the landlord verify any incoming tenant’s information by requiring a rental application to be completed and signed.

Minimum Termination Period

  • Outside New York City (§ 232-b): 1-month notice.
  • Within New York City (§ 226-c): 30 days if the tenant has been on the property for less than 1-year; 60 days if the tenant has been on the property one year or more; and 90 days if the tenant has been on the property for two (2) or more years.
