Indiana Lease Termination Letter Form | 30-Day Notice

An Indiana lease termination letter form is applicable to a month to month agreement when one party has decided to terminate the rental arrangement. This is a state requirement when terminating such a contract. That is, the state definition of a landlord, a tenant, and a month-to-month lease will obligate either party in making sure that if and/or when terminating a month to month lease contract, the party wishing to terminate must give thirty days’ notice before the actual date of termination. Thus it is very important to make sure that when terminating a month to month, this letter has been received by the recipient thirty full days before the termination date listed on it. Also, it is generally recommended to send such a time-sensitive document by registered mail or another delivery service that shall require a signature from the recipient when delivered.

Laws (IC 32-31-1-1) – Requires all parties, landlords, and tenants, to provide each other at least one (1) month (thirty (30) days) to cancel a month-to-month tenancy.

Of course, this is just a precaution. Generally speaking though, it would be a good idea to take certain measures to ensure a positive transition. For instance, while thirty days’ notice is required, informing the remaining party of the intention to terminate as soon as it is known may be consideration looked upon favorably. It should be noted that if a lease requires a particular place or method to send such a notice, one must obey the condition or instructions that one has agreed to by lease contract. This will ensure that terminating parties are in compliance both with the law and the lease they have signed previously.
