South Dakota Notice to Quit Form | Non-Compliance

Updated July 18, 2023

A South Dakota notice to quit (non-compliance) is a written request for a tenant who has violated a lease agreement for a reason not related to non-payment of rent to vacate a property within a reasonable timeframe. The state of South Dakota does not demand the landlord to give the tenant time to remedy the breach nor any grace period to do so, therefore the landlord, if he or she chooses, may demand the tenant to vacate at any time with proper notice for a violation of the lease agreement.

A breach may be due to the tenant using the premises contrary to the agreement or for the tenant’s neglect to make repairs in a reasonable time when asked to do so.
