Hawaii 5-Day (24 Hours to Cure) Notice to Quit Form | Nuisance

A Hawaii 5-Day Notice to Quit (Nuisance) is a form used by landlords to notify tenants that they have twenty-four (24) hours to resolve a nuisance. If the nuisance isn’t resolved within 24 hours, the landlord may terminate the tenancy by a written notice to vacate the premises within five (5) days from the date the second notice is received by the tenant.

In the event the tenant prepaid rent in advance, the landlord shall refund the amount of rent to which the tenant would have been entitled if vacated on the date on which the notice was delivered to the tenant. If the tenant remains to stay on the premises in default after failing to vacate after five (5) days while having had already paid rent in advance, the landlord may keep and allocate the money according to the number of days stayed in default until the tenant is officially evicted.
